1. Agreement to These Terms
By downloading, installing, or using the CryptoFax iOS application ("App"), or by accessing or using the website at https://cryptofaxreport.com ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Website.
These Terms constitute a legally binding agreement between you and Crypto Fax Report LLC ("CryptoFaxReport," "we," "us," or "our"). They apply to all users of the App and Website worldwide.
2. Description of Service
CryptoFaxReport provides an educational and informational service about cryptocurrency and blockchain technology. The App and Website offer:
- Educational content — lessons, guides, and explanations about cryptocurrency and blockchain fundamentals
- CFR Trust Scores — our proprietary, informational credibility ratings for individual cryptocurrency projects, based on publicly available data
- Market information — live and historical cryptocurrency market data, indices, and metrics displayed for educational context
- Curated news — cryptocurrency news articles sourced from third parties for informational purposes
CryptoFaxReport is not a financial services provider. We do not facilitate the buying, selling, exchanging, or transferring of any cryptocurrency or other asset. We do not provide investment advice, portfolio management, or brokerage services. See Section 10 (Financial Disclaimer) for full detail.
3. Apple App Store — Additional Terms
If you download the App through the Apple App Store, the following additional terms apply. In the event of any conflict between these Terms and the Apple Media Services Terms and Conditions, these Terms shall govern to the extent permitted by Apple.
3.1 Acknowledgement
You and CryptoFaxReport acknowledge that these Terms are between you and CryptoFaxReport only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
3.2 Scope of Licence
CryptoFaxReport grants you a limited, non-exclusive, non-transferable, revocable licence to use the App on any Apple-branded device that you own or control, as permitted by the App Store usage rules set forth in the Apple Media Services Terms and Conditions.
3.3 Maintenance and Support
CryptoFaxReport is solely responsible for providing maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
3.4 Warranty
CryptoFaxReport is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if applicable) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
3.5 Product Claims
CryptoFaxReport, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
3.6 Intellectual Property
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, CryptoFaxReport, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.
3.7 Legal Compliance
You represent and warrant that: (i) you are not located in a country that is subject to a United States Government embargo, or that has been designated by the United States Government as a "terrorist supporting" country; and (ii) you are not listed on any United States Government list of prohibited or restricted parties.
3.8 Third-Party Beneficiary
You and CryptoFaxReport acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms as they relate to your licence to use the App, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
4. Eligibility
You must be at least 13 years of age to use the App or Website. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction, if higher), you may only use the App or Website with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
By using the App or Website, you represent and warrant that you meet the eligibility requirements above.
Note on financial content: While the App is accessible from age 13, the financial disclaimer in Section 10 applies to all users. All content is educational only. We strongly recommend that younger users explore this content with a parent or guardian.
5. Licence to Use the App and Website
Subject to these Terms, CryptoFaxReport grants you a personal, non-exclusive, non-transferable, revocable, limited licence to:
- Access and use the App on your personal device for personal, non-commercial purposes
- Access and view content on the Website for personal, non-commercial purposes
This licence does not include the right to:
- Reproduce, distribute, or publicly display any content from the App or Website
- Modify, adapt, translate, reverse engineer, decompile, or disassemble the App
- Scrape, crawl, or use automated means to access the App or Website or any data therein
- Use the App or Website for any commercial purpose without our express written consent
- Sublicence or resell access to the App or Website
6. Intellectual Property
All content, features, and functionality of the App and Website — including but not limited to the CFR Trust Score methodology, educational content, text, graphics, logos, icons, data compilations, and software — are the exclusive property of Crypto Fax Report LLC, its affiliates, or its content licensors, and are protected by copyright, trademark, and other intellectual property laws.
The "CryptoFaxReport" name, "CryptoFax" name, CFR Trust Score, and associated logos are trademarks of Crypto Fax Report LLC. You may not use these marks without our prior written permission.
Third-party cryptocurrency market data displayed in the App and Website remains the property of the respective data providers and is used under licence or in accordance with their terms.
7. CFR Trust Score — Limitations and Disclaimer
The CFR Trust Score is CryptoFaxReport's proprietary informational rating system for cryptocurrency projects. You acknowledge and agree that:
- The CFR Score is not financial advice. It is an independent, informational credibility assessment based on publicly available information.
- The CFR Score is not a recommendation to buy, sell, hold, or avoid any cryptocurrency.
- The CFR Score may be inaccurate or incomplete. Cryptocurrency projects are fast-moving and our data may not reflect the most current state of any project.
- The CFR Score is provided "as is" without warranty of any kind, express or implied.
- A high CFR Score does not guarantee the safety, legitimacy, or future performance of any cryptocurrency.
- A low CFR Score does not guarantee that a cryptocurrency will perform poorly or is fraudulent.
You use the CFR Score entirely at your own discretion and risk. CryptoFaxReport accepts no liability for any decision made in reliance on CFR Score information.
8. Market Data and Third-Party Content
The App and Website display cryptocurrency market data sourced from third-party providers. This data is provided for educational and informational purposes only. CryptoFaxReport:
- Does not guarantee the accuracy, completeness, or timeliness of any market data displayed
- Is not responsible for errors or omissions in third-party data
- May experience delays or interruptions in data availability
- Does not endorse any cryptocurrency, project, or entity whose data is displayed
News articles and external content linked within the App or Website are sourced from third parties. CryptoFaxReport does not endorse, guarantee, or take responsibility for the accuracy, legality, or content of any third-party material. Your use of third-party sites and content is subject to those parties' own terms and privacy policies.
9. Acceptable Use
You agree not to use the App or Website to:
- Violate any applicable law, regulation, or third-party rights
- Engage in any activity that could harm, disable, overburden, or impair our systems
- Attempt to gain unauthorised access to any part of our infrastructure
- Use the App or Website to transmit malware, spam, or any harmful code
- Misrepresent your identity or affiliation with any person or organisation
- Scrape or harvest data from the App or Website by automated or manual means
- Use the App or Website in any jurisdiction where doing so would be unlawful
10. Financial Disclaimer
THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. PLEASE READ CAREFULLY.
CryptoFaxReport is an educational and informational service. Nothing on the App or Website constitutes:
- Financial, investment, or trading advice
- A recommendation or solicitation to buy, sell, hold, or trade any cryptocurrency or other asset
- An offer of, or invitation to engage in, any financial transaction
- Legal, tax, accounting, or other professional advice
Cryptocurrency is highly volatile and involves substantial risk of loss. The value of cryptocurrency can fall as well as rise, rapidly and unpredictably. Past performance is not indicative of future results. You may lose some or all of any amount you choose to invest in cryptocurrency.
Always conduct your own independent research and consult a qualified financial adviser, accountant, and/or legal adviser before making any financial decision. CryptoFaxReport is not authorised or regulated as a financial services provider in any jurisdiction.
CryptoFaxReport accepts no liability for any financial loss, damage, or other consequence arising from your use of, or reliance on, any content in the App or Website.
11. No User Accounts
CryptoFaxReport does not offer or require user account registration. No personal information is collected in connection with your use of the App. All use of the App is anonymous. For full details of our data practices, see our Privacy Policy at https://cryptofaxreport.com/privacy-policy.
12. In-App Purchases
The current version of the App does not offer in-app purchases. If we introduce paid features or subscriptions in future, we will update these Terms accordingly and notify users through the App prior to any charges being applied. Any in-app purchases, when introduced, will be processed through Apple's payment infrastructure and governed by Apple's applicable terms.
13. Availability and Changes to the Service
CryptoFaxReport does not guarantee that the App or Website will be available at all times or without interruption. We reserve the right at any time and without notice to:
- Modify, suspend, or discontinue the App or Website, or any feature thereof
- Update, amend, or change content, CFR Scores, or market data
- Impose limits on certain features
We will not be liable to you or any third party for any modification, suspension, or discontinuation of the service.
14. Disclaimers and Limitation of Liability
14.1 "As Is" Basis
The App and Website are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of information.
14.2 Limitation of Liability
To the fullest extent permitted by applicable law, Crypto Fax Report LLC, its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to loss of profits, loss of data, loss of goodwill, or financial loss — arising out of or in connection with:
- Your use of or inability to use the App or Website
- Any content accessed through the App or Website
- Any decision made in reliance on CFR Scores or market data
- Any cryptocurrency transaction you enter into independently
- Unauthorised access to or alteration of your data
In jurisdictions that do not allow the exclusion or limitation of liability for certain damages, our liability is limited to the maximum extent permitted by law.
14.3 Indemnification
You agree to indemnify, defend, and hold harmless Crypto Fax Report LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the App or Website, your violation of these Terms, or your violation of any applicable law or third-party rights.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law principles.
15.2 Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App or Website shall be resolved by binding arbitration in Broward County, Florida, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction where necessary to protect intellectual property rights or prevent irreparable harm.
You consent to the exclusive jurisdiction and venue of courts in Broward County, Florida for any matter not subject to arbitration under this clause.
15.3 Users Outside the United States
If you are accessing the App or Website from outside the United States, you do so at your own initiative and are responsible for compliance with applicable local laws. Nothing in these Terms limits your rights under the mandatory consumer protection laws of your country of residence that cannot be excluded by contract. For users in the European Union or United Kingdom, mandatory statutory rights under applicable consumer law are not affected by these Terms.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this document and display a notice within the App. Because we do not collect email addresses, we cannot notify you by email — please check these Terms periodically.
Your continued use of the App or Website after updated Terms are posted constitutes your acceptance of those changes. If you do not agree with updated Terms, you must stop using the App and Website.
17. Termination
We reserve the right to restrict or terminate your access to the App or Website at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
Upon termination, all licences granted to you under these Terms will immediately cease.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy at https://cryptofaxreport.com/privacy-policy, constitute the entire agreement between you and Crypto Fax Report LLC with respect to the App and Website, and supersede all prior agreements, understandings, negotiations, and discussions, whether oral or written, between you and us.
